ID Theft Bill Heading to President

After passing through both the House and Senate, the Identity Theft Enforcement and Restitution bill is heading to the president's desk, according to vnunet.com.

 

The law will create stiffer penalties and stricter definitions for identity and information theft crimes. Key provisions include:

  • Allowing victims of identity theft to sue criminals for restitution.
  • Eliminating the $5,000 minimum damages amount previously required for charges to be filed.
  • Making it a felony to install spyware or malware on more than 10 computers.
  • Allowing federal agents to pursue identity theft cases within a single state.
According to ITPro, the bill has garnered support from various U.S. and international industry bodies, including the Business Software Alliance (BSA) and Cyber Security Industry Alliance (CSIA).
